Terms of Service

These terms govern your use of the Budgeto website, apps, and services. Please read them before creating an account.

Who provides Budgeto

Budgeto is operated by Mitchell Martinez (ABN 40 927 243 914), based in New South Wales, Australia. In these terms, “Budgeto”, “we”, “us”, and “our” refer to that operator. By creating an account or using Budgeto, you agree to these terms and our Privacy Policy.

Eligibility and accounts

You must be at least 16 years old and legally able to enter into this agreement. You must provide accurate account information, keep your sign-in details secure, and promptly tell us about suspected unauthorised access. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.

The service

Budgeto provides tools for recording, organising, and reviewing personal budget information. It does not provide financial, investment, tax, credit, accounting, or legal advice. Outputs, projections, imported data, and optional AI assistance may be incomplete or inaccurate. You remain responsible for checking information and making decisions appropriate to your circumstances.

Subscriptions and payment

Some features require a paid subscription or add-on. Before you purchase, Budgeto will show the price, currency, billing period, included features, and any trial terms. Subscriptions renew until cancelled. You can manage or cancel them through the billing provider or Budgeto account settings applicable to your purchase. Unless required by law, fees already charged are not refundable. Nothing in these terms excludes rights or remedies that cannot be excluded under the Australian Consumer Law.

Bank Sync and third parties

Optional Bank Sync, payment, app-store, email, and AI features may rely on third-party providers and their terms. Availability can depend on your region, financial institution, platform, or plan. Imported transactions may be delayed, duplicated, categorised incorrectly, or unavailable. Review imported information before relying on it and keep independent records where necessary.

Your data and licence

You retain ownership of information you submit. You grant us a limited licence to host, process, transmit, back up, and display that information only as needed to provide, secure, support, and improve Budgeto in accordance with our Privacy Policy. You must have the right to submit any information you provide.

Acceptable use

You must not misuse Budgeto, access another person’s account, interfere with security or availability, introduce malicious code, scrape or overload the service, reverse engineer protected parts of the service except where law permits it, or use Budgeto to break the law or another person’s rights. We may restrict abusive automated traffic to protect users and the service.

Availability and changes

We aim to keep Budgeto reliable, but cannot promise uninterrupted or error-free availability. We may maintain, improve, add, remove, or discontinue features. Where a material change adversely affects a paid service, we will provide reasonable notice where practicable and honour any rights required by law.

Suspension and termination

You may stop using Budgeto and delete your account through account settings. We may suspend or close an account when reasonably necessary to address fraud, security risk, unlawful conduct, material breach, or harm to Budgeto or others. Where appropriate, we will give notice and a reasonable opportunity to resolve the issue. Terms that by their nature should continue after closure will survive.

Liability

To the maximum extent permitted by law, Budgeto is not liable for indirect or consequential loss, loss caused by information you enter or decisions you make, or failures outside our reasonable control. Where a guarantee under the Australian Consumer Law applies and liability can lawfully be limited, our liability is limited to supplying the service again or paying the cost of having it supplied again. These terms do not limit liability that cannot lawfully be limited.

Changes to these terms

We may update these terms to reflect service, legal, or security changes. We will update the date above and give reasonable notice of material changes. Where required, we will ask you to accept revised terms before continuing to use the affected service.

Governing law and contact

These terms are governed by the laws of New South Wales, Australia. Courts with jurisdiction in New South Wales may hear disputes, subject to any rights you have to bring a claim elsewhere. Contact [email protected] with questions or concerns.
